Man accused of hitting wife with lamp after she wakes him from nap

LAS CRUCES, NM (KTSM) - A Las Cruces man is facing charges after police say he beat and injured his wife Tuesday evening after she woke him up from a nap.

Levi Benitiz, 41, is charged with aggravated battery against a household member causing great bodily harm and a misdemeanor count of aggravated battery against a household member.

According to police, they were called to his home after 5 p.m. for a domestic incident. Investigators say Benitiz's wife found him passed out inside their home, possibly under the influence of alcohol or drugs. Each time, the woman attempted to wake him to check on him.

Around 5 p.m., the woman attempted to wake him for the second time and Benitiz allegedly hit his wife multiple times with both hands and grabbed a nearby lamp to hit her over the head several times.

The victim had multiple cuts to her head and right thumb. She was transported to Mountainview Regional Medical Center for injuries that are not believed to be life-threatening.

Benitiz was arrested inside their home and booked into the Doña Ana County Detention Center where he's currently being held without bond.
