Las Cruces shoplifting suspect allegedly headbutts, kicks officer

A Las Cruces shoplifting suspect is now facing additional charges after he allegedly physically assaulted the police officer who took him into custody.

According to a news release, Javier Chacon, 29, is accused of stealing a sandwich and bag of chips from the Circle K store located at 617 W. Picacho on Sunday evening.

Police say Chacon ran away from the store before a police officer found him at a nearby park.

According to the release, the suspect “actively resisted” when the officer tried to take him into custody.

Officials say Chacon then tried to bite the officer before he began headbutting and kicking.

The officer was not seriously hurt. Wrappers of the stolen items were found nearby.

Chacon was charged with battery upon a peace officer, shoplifting, evading or obstructing an officer, and assault upon a peace officer.

He is being held at the Dona Ana County Detention Center without bond.
