A man from Sunland Park was killed on Monday when he stopped to help a car that was stalled out on Interstate 10.

Byron Wade Cross, 46, was hit and killed by a 2002 Lincoln driven by Daniel A. Terrazas, 72, at about 4:45 p.m. on Jan. 28 on I-10 West near mile post 159, a New Mexico State Police news release said.

The investigation by the New Mexico State Police revealed that Cross had stopped to help a 2001 Volkswagen driven by Garcia Talamantes, 18, after it had stalled out in the middle of the road, the release said.

The Volkswagen was hit by a 2008 Chevrolet pick-up and then Terrazas swerved to avoid the collision but hit Cross who was standing on the right shoulder, the release said.

Cross was taken to University Medical Center in El Paso, where he died from his injuries.

Talamantes was given a traffic ticket for “stop, standing, parked on the roadway.”

Terrazas was given tickets for an expired drivers license, no insurance and careless driving. He was also arrested for an unrelated warrant out of Dona Ana County, the release said.
