El Paso City Council rejected a settlement with the family of a local bodybuilder who was shot and killed by an El Paso Police Officer in 2013.

Few details were available, but the City Attorney’s Office confirmed to KTSM that City Representatives voted not to settle with the Estate of Daniel Saenz.

Officer Jose Flores shot Saenz outside of the El Paso County Jail while Saenz was handcuffed and being transported to a hospital. Officer Flores was fired by EPPD in October 2014 but was later reinstated.

Saenz’ estate has filed suit against Officer Flores, the City of El Paso and the security company whose guard was assisting Officer Flores with transporting Saenz to the hospital the day of the shooting.

The suit is ongoing in federal court.
