The charges are dropped against the former Las Cruces Police Officers accused of beating a man in his jail cell back in December 2014.

The Doña Ana County District Attorney Mark D’Antonio and State Attorney General Hector Balderas jointly filed the paperwork Wednesday.

In the surveillance camera footage, Flynn can be seen handcuffed inside the cell with former officers Richard Garcia and Danny Salcido. Flynn was a suspect in a dispute with a neighbor before being placed in the holding cell.

Richard Garcia’s trial was back in June. He was facing felony charges of aggravated battery. The jury couldn’t reach a verdict and the case was declared a mistrial.

Danny Salcido was set to go to trial December 5th but that case will not go forward.
