Man points gun at nurse during treatment; Las Cruces Police officer wrestles gun away

A 56-year-old man allegedly pointed a gun at a nurse while he was receiving treatment on Tuesday.

Matthew Rodger Smith, of Hatch, was arrested on March 26 on suspicion of two counts of aggravated assault upon a health care worker and one count aggravated assault upon a peace officer.

The Las Cruces Police Department was called to the Fresenius Kidney Care, 3875 Foothills Dr. at about 4 p.m. because Smith was allegedly having sudden outbursts and directing profane language towards the staff,  a news release from police said.

When the officer entered the room, Smith allegedly took out a loaded .357 revolver and pointed it at one of the nurses. The Las Cruces Police Department Officer knocked the gun out of Smith’s hands and took him to the floor as a nurse kicked the gun away, police said.

No one was injured and Smith was arrested and booked into the Dona Ana County Detention Center without bond.
