El Paso, TX (KTSM) — A Complaint Affidavit obtained Wednesday afternoon against Jenna Farrey reveals that new charges of Injury to a Child have been charged against the mother of two, who's infant son was found in the New Mexico desert in November.
The affidavit states that Jenna Farrey and her husband, Jeffrey Farrey, admitted that 5-month-old Jackson Farrey was found unresponsive and that Jenna and Jeffrey failed to seek medical care for the infant. The date of the offense is listed as October 27, 2013, nearly three weeks before the family was reported missing.
As we've reported, the Farrey family was reported missing November 15, 2013, and was found days later in a Michigan motel, but their 5-month-old, Jackson Farrey was not with them. The infant's body was found November 20th, buried in the desert near Orogrande, NM.
According to the affidavit, Jenna and Jeffrey both admitted that Jackson was dead before the infant was buried in the desert near Orogrande, NM.
The latest charge against Jenna Farrey was filed January 27 at 4:29 a.m. As a result of the new charges, Judge Sam Medrano set bond at $1.5 million for Jenna. The affidavit claims that Jenna caused injury to a child by intentionally, knowingly, recklessly, or with criminal negligence caused serious bodily injury to Jackson Farrey.
El Paso area Attorney Dereck Wyatt, who is not Farrey's Attorney, advised NewsChannel 9 that the charge Farrey is facing carries a possible sentence of 5 to 99 years, or life in prison.
Jenna Farrey has not posted bond since Judge Medrano set bond Tuesday afternoon, she remains in the El Paso County Detention Facility as of Wednesday afternoon. No court date has been set for Jenna Farrey. Her husband, Jeffrey Farrey will go to trial in October 2014.
