Albuquerque, NM — A man in New Mexico who pleaded guilty to killing his five-year old stepson after the boy wet his pants has learned his fate.
A judge sentenced Richard Gutierrez to 30 years behind bars, on Tuesday. Prosecutors say Gutierrez was so angry that the boy wet his pants that he threw 5-year-old Isaiah Ithurria to the ground so hard the child lost consciousness.
The child's mother, who was attending a college class when it happened said "Little did I know that so-called accident was no accident, and that it was caused by a man I once trusted."
His grandmother asked for the maximum penalty the law would allow under the plea deal, 30 years. "Every second, every minute, every hour and every year matters to the family. Because 30 years is nothing compared to the loss of our precious Isaiah." she said.
At just five year's old, Isaiah's family says he had dreams of playing for the Green Bay Packers, going to college and following in his uncle's footsteps to become a firefighter.
"Isaiah was loved by so many people. He had amazing blue eyes that could light up a room with smiles as soon as you looked into them." his grandmother said.
Gutierrez was also ordered to get parenting and anger management classes. The judge ruled when Gutierrez is released, he will be on supervised probation and will not be allowed to be around children under the age of eighteen.
