NBC — The Texas National Guard is defying orders from the Pentagon and is refusing to process requests from same sex couples for benefits. Tuesday is the first day that gays in the military may apply for benefits, and Pentagon officials say Texas is the only state that is turning gay and lesbian couples away.
This all comes on the heels of the U.S. Supreme Court's decision to throw out the Defense of Marriage Act. National Guard officials say the state's constitutional ban on gay marriage prohibits them from processing requests, although Guard officials in other states that ban same sex marriage say they will follow federal law.
