EL PASO, TX (KTSM) — The man accused of killing his girlfiend's 11-month old baby last September will finally have his day in court.
The trial for 21-year-old Irving Gomez was set for Sept. 27, just a little more than a year since the alleged killing.
Gomez was accused of murdering 11-month old Neveah. He's been charged with capital murder and has been in jail since his arrest in September.
El Paso Police said Gomez suffocated the baby by putting two fingers down her throat to stop her crying and returned to bed.
About 30 minutes later, police said Gomez got up, called his girlfriend and they rushed her to the hospital where Neveah died.
Days after his arrest, News Channel 9 confimed Gomez was not a U.S. citizen and could be deported after serving his jail sentence if convicted.
