LAS CRUCES, N.M. — A judge presiding in some of the Sunland Park Corruption trials has asked for recusal from one of the cases, according to court records.
The records show newly elected Judge Marci Beyer asked for a recusal in the Luis Rene Diaz trial.
Diaz is charged with extortion and fraud among other things for his alleged role in the making of a video allegedly used to extort mayoral candidate Gerardo Hernandez.
Diaz's attorney said they did not ask for the judge to be removed.
Judge Beyer's staff said they could not elaborate on the reason behind the recusal.
Beyer was also assigned to preside over the case of former Sunland Park mayor-elect Daniel Salinas who is facing multiple charges.
A new judge has been assigned to his case.
Diaz was scheduled to go on trial earlier this week but will now wait for a new judge to be assigned.
