EL PASO- Closing arguments for Daniel Villegas are set to take place this morning.
Villegas is currently serving life in prison after being found guilty of double homicide in the mid 1990's. Villegas claims he was forced to confess to a crime that he didn't commit. In September the judge spent nearly two weeks listening to witness testimony on why Villegas' legal team feels he deserves a new trial.
Judge Sam Medrano can't grant Villegas a new trial, but he can send a recommendation to an appeals court in Austin for them to grant him a new trial.
UPDATE: 1:15 p.m.- In recorded phone call conversation with his mother in Sept. 2011 Villegas tells his mom he doesn't have actual innocence. Jailhouse recording from last month shows Daniel Villegas saying, " Please God, let me out of here even though I'm not innocent."
There has been at 10 minute break. The hearing will resume with rebuttals in 10 minutes.
