LAS CRUCES- Police have arrested a man accused of raping his girlfriend after a long night of drinking.
Ruben E. Rivera, 30, is charged with one count each of criminal sexual penetration, aggravated battery against a household member, false imprisonment and driving under the influence.
Police say Rivera began drinking early Sunday morning. Sometime before 7:00 p.m. Sunday a noticeably intoxicated Rivera returned home and began demanding to have sex with his girlfriend.
The 28-year-old woman repeatedly declined the advances and tried to leave the house but Rivera refused to allow her to do so. Rivera continued to demand sex with the woman and eventually raped her. The woman eventually escaped to a neighbor’s home where she called 911.
Rivera left the house before police arrived, but he returned while officers were conducting their investigation. He was arrested for DWI, his second such offense, and his vehicle was seized under the city’s DWI forfeiture ordinance. Rivera was transported to the Dona Ana County Detention Center with bond set at $26,000.
