EL PASO - We have new and disturbing details tonight about an El Paso Police Officer. One day after the arrest of Zake Rivera on sexual assault charges, we've learned he's accused of forcing the victim to give him oral sex in the back of his patrol car. Rivera was arrested yesterday and is now on administrative leave.
"The evidence is actually quite condemning in that regard," said police chief Greg Allen.
An arrest affidavit accuses 29-year-old Zake Rivera, a 4-year police veteran, of taking advantage of a victim in a domestic fight. Just before 1 a.m. on January 23, Rivera and his partner responded to a fight between a husband and wife in the 700 block of Mesa Hills.
The affidavit says while investigating, Rivera escorted the woman to his patrol car and had her sit in the back driver's seat with the door open. The report says he made her perform oral sex on him without consent.
Chief Allen announced the arrest at a press conference yesterday.
"Sometimes you get poor quality and in this case it's a possibility," Chief Allen said.
The affidavit also says there was DNA evidence on the victim's clothing found to be associated with Rivera.
"In this particular case his denial of the event is not going to alleviate this particular charge because we have enough evidence that points that he did do the offense," Chief Allen said.
We also dug up some records from 2006 that show the Civil Service Commission voted to disqualify Rivera from taking the exam to become a police officer.
We asked both the police department and the city who overruled that decision, what he did that made this commission feel he should be ineligible, and why Rivera was allowed to stay on the force.
Police told us to contact the Civil Service Commission directly. City hall is closed today and the commission did not return our calls.
“I'm having our training division look at whether or not the hiring of this individual was probably an error to begin with,” Chief Allen said.
Rivera has posted bond. A termination hearing for him is scheduled for March 7th.
