EL PASO - Judge Gonzalo Garcia has declared a mistrial in the David Marmolejo murder trial. After three days of deliberations, a local jury could not come to a decision.
Around 4:30 p.m. the jurors told the court they were deadlocked.
About fifteen minutes later, Judge Garcia brought the jurors back to the courtroom and asked if they needed more time to deliberate.
The foreman said a unanimous decision would not be made. That's when Judge Garcia relieved the jurors of their duties. The gag order for all still involved with the case remains.
David Marmolejo is accused of strangling his mother to death and dumping her body in the Santa Teresa desert last July.
A hearing is scheduled next week to determine the retrial date.
