A federal judge in El Paso re-sentenced a former Border Patrol agent over a shooting three years ago.
The judge decided this morning to keep Jose Compean's original 12 year federal prison sentence.
Now his supporters have planned a candle light vigil in front the county jail.
To oppose his conviction and sentence.
Compean was convicted along with fellow border patrol agent Ignacio Ramos in 2006.
The men tried to cover up their shooting of drug smuggler Osvaldo Davila as he ran away from them near Fabens.
An appeals court ordered the resentencing after throwing out a tampering charge earlier this year.
Ramos will also have a re-sentencing hearing tomorrow morning also at the federal courthouse.
