EL PASO--- The owner of Poki Roni, a beloved horse riding ranch, will be tried for assisted suicide following an indictment handed down by a grand jury.
Travis Kirchner spoke to NewsChannel 9 off-camera today.
He said he wants the public to know his side of the story.
Kirchner and his mother, Patricia, both ran the Poki Roni Ranch.
It was September when Patricia was found dead inside a car at her home.
Court documents show Travis told police he and his mother made a suicide pact, to both die in a running car in a sealed garage.
He told us the decision came after his 81-year-old mother came down with Parkinson's disease, and after a judge ordered the ranch to close.
While first charged with murder, a grand jury has now indicted Travis for assisted suicide in his mother's death.
Because carbon monoxide was used as a weapon, the DA's office says he could face up to 10 years in prison.
But Kirchner says even though he's admitted he and his mother were suicidal, he has no plans to plead guilty at this Monday's arraignment.
He told NewsChannel 9 Wednesday it was all his mother's idea; that "she concocted the plan" to give away their assets and how they would die.
"My mother even chose Mozart's 'Requiem" to play in the car's CD player.
The indictment against Kirchner also says he "placed" her into the car.
But he denies that, saying they "walked side-by-side into the garage," and she got into the car on her own terms.
He says she even told him that day, "I'm excited about this."
The district attorney's office wouldn't comment on the case.
