If this couple had been married this man's father would still fighting to have his son's ashes. There will always be someone that will go against the decision of the one that is in charge whether it be a family member or ex-spouse or children, you can not please everyone even if everyone comes to an agreement. But, In the state of Texas she is legally his wife, if they lived together as husband and wife and recognized eachother as husband and wife then, she is his wife license or no license.
