LAS CRUCES — A 27-year-old woman who left her three young children home alone early Thursday morning while she went out to breakfast has been charged with child abuse.
Luz Gutierrez, faced third degree felony charges with one count of intentional child abuse.
Shortly before 3:30 a.m. Thursday, police were called to Gutierrez’s apartment after her 8-year-old son walked next door to his aunt’s residence, wondering where his mother was. Officers entered Gutierrez’s apartment and found the condition of her residence to be deplorable.
About 25 minutes after officers arrived at her apartment, Gutierrez returned and said she had been at a Denny’s restaurant with a friend.
Las Cruces Police detectives noticed foul odors emitting from the refrigerator and kitchen sink, and moldy bread on the floor. Detectives also documented spoiled food and piles of dirty clothes and dishes within the apartment.
Gutierrez’s three children – ages 8, 6 and 4 – displayed no signs of physical harm and were turned over to the custody of their grandmother.
Gutierrez was arrested and transported to the Dona Ana County Detention Center.
