Former EPISD superintendent Lorenzo Garcia is getting out of prison early, and we now know why.

Garcia is completing the "Residential Drug Abuse Program" at USP Lewisburg which, under law, will allow him an early release.

A judge sentenced Garcia to 40 months in prison in October 2012 because of the cheating scandal he spearheaded and for defrauding the government.

NewsChannel 9 exclusively reported Garcia's expected early release, set for Nov. 1, 2014. He was originally set to be released a year after that.

The drug abuse program is for "every prisoner with a substance abuse problem", according to Title 18 USC § 3621. "The period a prisoner convicted of a nonviolent offense remains in custody after successfully completing a treatment program may be reduced by the Bureau of Prisons, but such reduction may not be more than one year from the term the prisoner must otherwise serve," it says.

When asked if Garcia does indeed have a substance abuse problem, BOP spokesman Chris Burke said "we cannot comment on that."
