EL PASO - Police officer Mark Munoz was supposed to go on trial for sexual assault next week. The trial has been pushed back because a new indictment was just filed yesterday, and now there's a new allegation.
"He said, be a good girl, be a good girl," said the woman who says Munoz assaulted her.We interviewed her last November.
She says on Halloween night a year and a half ago, after working at the Comic Strip, she and some coworkers went out for drinks. She says Munoz, who said he was one of the owners of the club, tagged along and bought her some drinks.
"He said multiple times, I'm your boss, I'm going to take care of you, I'm going to take care of you," she said.
She says she began to feel sick, and Munoz drove her home. She says she blacked out, and when she woke up, Munoz was touching her inappropriately.
"I said no, and it hurt, and I tried to turn away, but I couldn't really move," she said.
Police documents show investigators found a clear capsule with a green substance in her car. Munoz was originally indicted in October of last year. The new indictment accuses Munoz of penetrating the sexual organ of the victim by means of the finger. It claims he did so while she was unconscious and physically unable to resist. And the new indictment accuses Munoz of using physical force or violence.
He will have ten days to review the re-indictment and a new court date will be set.
We talked to the woman who says Munoz assaulted her today. She says she's discussing the possibility of testifying against him. Police say Munoz is still on administrative duty. We tried calling his attorney today, but we have yet to hear back.
