Retrial begins for 2008 murder
Las Cruces, NM (KTSM) — A retrial began Monday against a man accused of killing his housemate six years ago.
Las Cruces police say James Bogart killed his housemate in March 2008 at the home in the 2800 block of Diamond Springs.
Bogart, who is wheelchair-bound, had been living with the then 30-year-old Jeremy Hernandez, an Army Ranger, and his wife.
Bogart claimed he shot Hernandez to death because he was defending the woman while the couple was having an argument.
The judge declared a mistrial for Bogart's second-degree murder trial in December, after a jury could not come up with a verdict.
They did find him guilty of tampering with evidence in the December trial.
