The U.S. Dept. of Justice Federal Bureau of Prisons has responded to Congressman Beto O'Rourke's call to reverse former EPISD superintendent Lorenzo Garcia's sentence reduction.

As NewsChannel 9 first reported in October, Garcia, 58, will complete his sentence in November 2014, a year earlier than Judge David Briones recommended.

He was convicted in October 2012 of leading one of the most controversial corruption scandals in El Paso.

The scheme kicked students out of school all in order to raise the district's test scores which gave Garcia thousands of dollars in bonuses.

There currently remain 6 unindicted, unidentified co-conspirators.

The Bureau of Prisons allows for early release up to a year if an inmate convicted of a non-violent crime completes the Residential Drug Abuse Program.

However, Judge Briones was clear in his recommendation that Garcia should not be afforded that opportunity.

After our report, Congressman O’Rourke contacted the Federal Bureau of Prisons through a letter to demand an explanation.

The Congressman released a letter to NewsChannel 9 from BOP Assistant Director Frank Strada, dated Dec. 4, 2013.

"The Bureau makes every attempt to satisfy judicial recommendations when such requests are consistent with Federal law, regulations, policy, and sound correctional management," wrote Strada.

O'Rourke also shared his response to that letter, saying the letter did not clearly answer his questions and asked they "articulate in detail what attempts the Bureau made to satisfy this unambiguous judicial recommendation, and what factors and considerations led to the Bureau's decision to defy the recommendation in this case."
