NM officials push for issuance of gay marriage licenses
SANTA FE — Santa Fe city leaders were pushing for county clerks across the state to issue marriage licenses to same-sex couples.
They were sponsoring a resolution supporting gay marriage that was set to be introduced at their city council meeting Wednesday.
Their city attorney said there was no in the books that prohibited same-sex marriage, therefore there was nothing keeping clerks across the state from issuing same-sex marriage licenses.
Doña Ana county Clerk Lynn Ellins however said that wasn't the case.
"I don't have the legal authority to do that," he said. "If the law was changed to permit the issuance of marriage licenses to people of the same sex, then I would."
