NM Attorney General will not take action against Dona Ana County
LAS CRUCES, N.M. — New Mexico Attorney General Gary King issued a statement Wednesday afternoon and said he will not pursue any action against Dona Ana County for issuing marriage licenses to same-sex couples.
Dona Ana County Clerk Lynn Ellins announced Wednesday morning his office would begin issuing licenses to all applicants regardless of gender.
King said he will not pursue action against the county and added their position remains the current law is unconstitutional and would prevent them from pursuing court action to stop Ellins or any other clerks.
He added he had previously advised against issuing same-sex marriage licenses due to the uncertain status of the law.
King said it would be a lot safer for couples to wait until the New Mexico Supreme Court makes a ruling before moving forward.
