Manure Dumped Near Road

SUNLAND PARK, NM - Neighbors in Sunland Park say they've seen a woman dumping manure by the wheelbarrow right on the side of the road.
They say they've called police, but nothing has been done. So they called us, and we talked to the woman who's been doing the dumping.
"Yes, I dump it and spread it out there," Marcia Moyer said.
Moyer takes care of horses for a Sunland Park homeowner. She admits the homeowner doesn't own the land on the side of the road, but she says a land deed allows the homeowner to use that property anyway. She says no one has the right to tell them how to use the land, in this case to dump manure on.
"I don't think they have any say so, nor do we have any say so. Only the government owns it."
To address our viewers concerns we called the Sunland Park city manager. He said several people have complained and code enforcement is working on getting the manure cleaned up. That could include the city taking Moyer to court, but Moyer insists that nothing illegal is going on.
"We're within the bound of the law, and I'm sure these people that have complained aren't aware of it."
Moyer also told us the manure isn't harming anyone.
"I don't know what the danger would be, it's spread out and dries out. Actually it's a good type of fertilizer so I can't see why there would be a danger, no."
We also called the New Mexico Environment Department to clarify whether or not this is legal. We we're told based on New Mexico's surface water and groundwater laws it sounds like the horse manure dumping is illegal.
