A group of El Paso business owners continue to fight back against the stormwater fee. Many believe it is unfair and will severely hurt their bottomline.

ONLY ON 9: Fight to Rescind Stormwater Fee

Friday, May 16, 2008 - Gary Hoff, the owner of Blimp sandwich shop is among those business owners who says the fee is just too much. He is also part of an effort that is being organized to begin the process to rescind the stormwater fee. The group of business owners is also planning a possible recall of 5 members of the El Paso City Council. Major John Cook has been one of the strongest supporters of the stormwater district, which collects the fees, and from what newschannel 9 has learned, Mayor Cook will likely be a target of the recall. The mayor tells us the group has the legal right to try and recall the district, but it will not be successful because the stormwater district is potected under state law, which requires it to remain in effect for five years. As for the possibility of his position also being up for recall, Cook says a petition would need signatures from 5 % of registered voters at the time of the last general election. Those signatures would need to be collected and validated before any recall election could take place. Newschannel 9 is told this group may officially announce plans for the recall within the next few days.
