The Association wanted the judge to prohibit the city from collecting the fee until the courts decide wheither it's constitutional. The injunction was denied after city leaders agreed that stormwater fees will be refundable if the Apartment Association prevails in a lawsuit. That suit claims the stormwater fee is unconstitutional.
