A 33-year-old Las Cruces woman has been charged in the death of her infant daughter.

Annette Smith, of the 300 block of Foster Road, is charged with one first-degree felony count of intentional child abuse resulting in death and one count of tampering with evidence, a third-degree felony.

Las Cruces police say shortly before 7 a.m. July 9, they were dispatched to the report of CPR being performed on 7-month-old Shania Smith inside the apartment. The infant was rushed to Memorial Medical Center but was pronounced dead shortly after arrival.

Las Cruces Police detectives said that Tuesday evening Smith covered Shania in several layers of blankets in order to avoid hearing her cry. They said the air conditioner in Smith’s apartment was believed to be inoperable or not utilized during the time.

The body of the 7-month-old girl will be sent to the state medical investigator’s office in Albuquerque for autopsy.

Three other children in the home – ages 18-months, 12 and 13 – have been turned over to the custody of the state.

Smith is expected to be booked into the Dona Ana County Detention Center where she is being held on a $1 million bond.
