Las Cruces mayor signs letter in suport of the Mortgage Fair Foreclosure Act

Las Cruces resident Sherry Kirk, 64, thought she would be spending her golden years enjoying retirement, but instead she's facing foreclosures.

Kirk tragically lost her husband after being beat from a neighbor when we outside to pick the paper.

"I just couldn't believe he was gone just like that he was gone," Kirk said.

After his passing she stopped receiving part of his retirement income and began having trouble making mortgage payments.

"I needed to talk to Bank of America, the electric company, the gas company and tell them this is what my income is now," Kirk said.

She did her best to stay afloat, even looking for a roommate to help pay the mortgage.

All the while the bank didn't budge with their negotiations.

"Give me a payment I can afford," Kirk said she repeatedly told the bank.

Kirk said she will continue her fight for her home and has joined Communities in Action and Faith, a group working to help keep people in their homes.

CAFE asked Las Cruces Mayor Ken Miyagishima to sign a letter Thursday showing support of Senate Bill 1.

The bill would help prevent foreclosures by making sure homeowners are informed of their options and would stop the "dual track" process that currently allows lenders to file foreclosures while homeowners seek alternatives.

"Homeowners just need time," said Rose Ann Vasquez with CAFE. "They need time to negotiate and make reasonable negotiations with their banks in order to get out of foreclosure."

The letter will be headed to Santa Fe directed at several state legislators.

"I think SB 1 will actually put teeth into the bill and allow the homeowner while they're working out some kind of arrangement to prevent the banks from foreclosing," said Mayor Ken Miyagishima.
