Ex-Irvin High School teacher requests 50-year child porn sentence to be thrown out

A former Irvin High School dance teacher convicted of child porn was in federal court on Thursday afternoon requesting to have his 50-year sentence thrown out.

Marco Antonio Alferez pleaded guilty in 2011 to one count of sexual exploitation of minors and distribution of child porn, as part of a plea deal.

But Alferez argues federal agents never gave him a copy of the search warrant when they entered his home and arrested him in 2010.

His attorney argues all the evidence seized at that time should have been suppressed.

In court on Thursday, Alferez's former defense attorney, Michael Gibson, said he made "a grievous tactical error" by not filing a motion to suppress evidence, thinking that at the time, it would be in Alferez' best interests to try and work a deal with the prosecution instead.
