UPDATE: Tuesday, August 2, 7:45 a.m. - Dr. Lorenzo Garcia is scheduled to be arraigned at 2:30 p.m. today.

EPISD said Dr. Terri Jordan, the district's chief of staff, would be in charge of day-to-day operations in the superintendent's absence.

UPDATE: 4:06 p.m. The indictment charges Garcia with one count of conspiracy to commit mail fraud, two counts of mail fraud and one count of aiding and abetting theft from programs receiving federal funds.

According to the indictment records, from February 1, 2006 until March 11, 2007, Garcia and others conspired to defraud EPISD by securing a $450,000 sole-source contract under false pretenses.

The indictment specifically alleges that Garcia provided $5,000 to an unindicted co-conspirator (UCC) of which $4,000 was deposited into the UCC’s company bank account. Garcia also convinced UCC, with whom he had a personal relationship, to enter into a contract with EPISD and to represent the value of the contract to be approximately $500,000–$400,000 more than what the UCC believed was the true value of products and services rendered.

The indictment also says Garcia hired an attorney to prepare documents to eliminate any competition for the UCC. In July 2006, UCC, at the direction of Garcia, submitted an affidavit and a letter to EPISD seeking a no-bid contract claiming that UCC’s company was the only source of the products and services offered to EPISD.

In August 2006, the UCC received two checks from EPISD in the amount of $180,000 each. Finally, the indictment alleges that Garcia failed to disclose to the Board of Trustees his personal relationship to the UCC as well as his personal financial interest in the vendor company.

Each of the mail fraud related charges and the theft charges contained in the indictment call for up to 20 years and up to 10 years, respectively, in federal prison and a maximum $250,000 fine upon conviction.

 

 

UPDATE: 3:38 p.m. According to the county jail website, Garcia is charged with In-transit Mail Fraud. He has been booked into the jail. Jail records indicate there is no bond for Garcia.

UPDATE:  3:08pm:  The EPISD just released the following statement on the arrest of Superintendent Lorenzo Garcia:  "We are not privy to any details right now. Our Board of Trustees will be meeting today at 4:30 p.m. and will hold a news conference at the conclusion of the meeting."

EL PASO - The FBI has arrested El Paso Independent School District Superintendent Dr. Lorenzo Garcia.

Multiple sources confirm Garcia's arrest to NewsChannel 9.

According to those sources, FBI agents entered Garcia's office at EPISD headquarters, handcuffed him and led him away around 1:05 p.m. today.

Garcia's initial court appreance will be tomorrow at the Federal Courthouse.

Details surrounding what, if any charges Garcia faces have not been released.

Calls to the EPISD public information office have not been returned.

If the board votes to keep Garcia employed then we should recall all of them!!!! He should be fired immediately not let go on any kind of leave. And to even consider a "buy" out? Hasn't he already TAKEN his "buy" out? REALLY!!!

Don't accuse teachers along with this greedy "leader". They are just as powerless as everyone else. The people that work directly with him definitely.

And Pleeease, refrain from your bible passages, to try and make a wrong right. This guy seems like a dirt bag making $300,000+ trying to get more money and affection at the same time. Save your preaching for sundays, or whenever you worship.

OK this dirt bag is convicted, but not proven guilty. lets give him the benefit of the judicial system to find him guilty/not guilty. Given his past allegations, and accusations do you think the EPISD board of trustees, would have done their "Due Dilegence" when dealing with this clown? No, the EPISD board of trustees gets handed a Rubber Stamp when sworn in, vote the right way, dont question anything at all. Shame on #1.us for voting these clowns in, and Shame #2 for keeping them in power.

This news does not surprise me one bit! El Paso is just like its "Sister City" in the fact that all of the officials are greedy, connected to everything illegal, and of course corrupted. It is a shame that all these "leaders" steal from the hard working tax payers of this city. And the funniest thing about it is that not one citizen has a clue as to what is really going on. This city is pathetic! There are no jobs for teachers, but"leaders" obviously making a killing off of us. Thanks El Paso!

We should stand up and we should demand and we should be more politically active. Does anyone know when local city meetings are held? IT IS time for the tax payers to wake up and start voicing their rights. Everyone complains but nobody wants to get involved. This is why we didn't support the TRE!!! I cannot believe there is the superintendent's cabinet, then 5 associate superintendents and 5 assistant superintendents. Really people? No wonder they are always crying for money!!!
I believe it is high time that our local government from Mayor to City Council to Judges, to school superintendents to teachers be investigated. Power for money = crooks!! And we are paying their salaries. Wake up people. Stop voting these low lifes into office over and over again.

Well JJJCCC you know it was V Math, especially after Tracy Rose is now the other person of interest. You better believe that program was a bunch of nonsense, and all of his "yes men" trying to push it on us to teach it. Unbelievable...unbelievable.

I'll bet it has in one way or another, having to do with "construction companies". Construction Companies bid for jobs pending on repairs or additions to schools. There is no fair-play when it comes to bidding for the jobs. With a position like Mr.Garcia, he can easily make sure who gets the job...for a good price, that is.

I like to know where $15 million went from employee self funded insurance account from 2007 - 2009. FBI needs to find out where that money went!! In 2007 it was $17 million at the beginning of August with employes contributing around $45 million each year to $2 million in August of 2009.

I'm waiting for the FBI to look into the 48 million+ Clint High school project that was pushed and sold to be built on the property belonging to one of the school board members, along with that they also had to pay or lease property rights on adjacent lands to the new high school in order to get utilities there, that property also belongs to school board member and affiliates. That's amazing considering CISD already owned frontage property that was originally going to be used to build the new high school. Look at the new superintendent he's hired all buddies from SISD where he was before. people that went from teacher's status to asst. superintendent a former security guard running the security department, a former squeeze with asst. superintendent status, Aunt and nephew running finance, wow and no one s looking into this.

I agree. They just investigated the Georgia school district for teachers fudging test scores for funding. How about the FBI moving into the EPISD and our local city government to tell us where the billions the city collects each year in property taxes goes. I have asked over and over again but I never get an answer. Now the electric company wants to hit us up for another fee to pay for their screw up in February.
