El Paso, TX (KTSM) — Luis Castruita is accused of shooting 22-year-old Efren Gonzalez in the Miner Plaza parking lot just before 2:30 a.m. Saturday morning, and this isn't the first time Castruita has been in trouble for allegedly shooting someone.
In an indictment obtained by News Channel 9, Castruita is charged with aggravated assault with a deadly weapon for allegedly shooting Mark Gaitan in Bexar County, Texas on August 10, 2012.
Bexar County, the county where San Antonio is located, charged Castruita with knowingly and recklessly causing serious bodily injury to Gaitan. In addition, Castruita was indicted on charges of a felon in possession of a firearm.
Castruita was convicted in the U.S. Western District court of conspiracy to possess with intent to distribute marijuana over 1,000 kilograms in January of 2005. He had been on supervised release at the time of the 2012 shooting.
Castruita was arrested by the El Paso County Sheriff's Department and extradited to Bexar County on October 7, 2013 in connection with the alleged 2012 shooting. He was released on bond December 11, 2013.
According to Bexar County District Attorney Donna McKinney, court records indicate that Castruita was set to issue a plea in the 2012 Aggravated Assault case in the 175th District Court on Friday, March 28, 2014.
When contacted for comment regarding Castruita's involvement in the Bexar County case, a spokesman with the El Paso Police Department stated that they are currently working with other law enforcement agencies across the state in the Castruita case.
