A Las Cruces man is behind bars, charged with one count of robbery, aggravated assault with a deadly weapon, tampering with evidence, and battery after a fight with a neighbor escalated Sunday night.

LCPD officers were dispatched to the 3900 block of Saddle Fork Court where witnesses in the area reported a fight between two neighbors. Officers arrived and learned that John Hamilton, 46, and his unidentified 61-year-old neighbor were talking about the possibility of a car sale when Hamilton got upset with the neighbor over what he considered to be an unreasonably low offer.

Police investigators learned that the 61-year-old began to leave when Hamilton allegedly struck him, knocking him over. Hamilton then allegedly grabbed his neighbor's gun that was legally holstered at his side.

That's when LCPD believe that Hamilton hit and kicked the neighbor multiple times while armed with the gun. The 61-year-old was not seriously injured in the attack.

Hamilton returned to his home where he hid his neighbor's gun in a bedroom. Police were able to locate the .40 caliber firearm in Hamilton's home and took Hamilton into custody.

Hamilton was booked into the Dona Ana County Detention Center with a bond set at $10,000.
