County Ethics Commission Chairman Plans to Plead Not Guilty
The former El Paso County Ethics Commission Chairman charged with sexual assault plans to plead not guilty. David Chavez' attorney has strong opinions about the judge in this case.
Tonight, Theresa Caballero is going public with her criticism. Caballero's client, David Chavez, last appeared in court on Tuesday. He's accused of sexually assaulting a female relative who's now pregnant.
Caballero did not appear with Chavez in court because she wants the judge, Patricia Harris, recused.
When asked why she wants Judge Harris out of the picture,
Caballero said, "She can't be fair."
Caballero said several fellow attorneys have problems with the judge and that "She needs to back off."
Caballero is also fighting a protective order against Chavez.
Now as we've reported, police say there's a second criminal allegation against Chavez.
