The two men who were named in a criminal complaint that alleged a sexual assault against a pair of teenage girls have been indicted by a grand jury on charges related to the incident, investigators said. 

Marcos Anthony Moncayo and Eloy O. Gonzales, both 21, were formally indicted Thursday in the Third Judicial District Court.

Moncayo is charged with criminal sexual penetration, conspiracy to commit criminal sexual penetration, criminal sexual contact of a minor, two counts of contributing to the delinquency of a minor, two counts of conspiracy to commit contributing to the delinquency of a minor, two counts of selling or giving alcoholic beverages to a minor and two counts of conspiracy to commit selling or giving alcoholic beverages to a minor. 

Gonzales is charged with two counts of contributing to the delinquency of a minor, two counts of conspiracy to commit contributing to the delinquency of a minor, two counts of selling or giving alcoholic beverages to a minor, and conspiracy to commit criminal sexual penetration.

On Jan. 12, investigators with the Doña Ana County Sheriff’s Department allege Moncayo and Gonzales went to the home of two 14-year-old girls after meeting them on a social networking site called MocoSpace.com.

The girls told investigators they had originally claimed to be 20 years old, but reportedly confessed to Moncayo that they were underage.

According to court documents, the men gave the girls alcohol and then Moncayo reportedly engaged in sexual intercourse with one of the girls.

Moncayo and Gonzales were arrested and booked into the Doña Ana County Detention Center. Both have since bonded out.
