Pump Buster: Rules and Regulations

Communications Corporation of America, it’s subsidiaries and affiliated companies, (hereinafter “Company”), will conduct the contest substantially as described in these rules, and by participating, each participant agrees as follows.

The station is participating in a contest called “PumpBuster Drive Away” which begins April 23, 2008 and ends May 21, 2008.  NO PURCHASE IS NECESSARY.  You could win $200 in gas or a Honda Fit.  Watch NewsChannel Nine at 10PM (M-F during contest dates) for the PumpBuster code to be revealed.  Register online at ktsm.com by clicking on the PumpBuster Drive Away icon on the homepage.  Registration form must have the correct secret code or will be disqualified.  Viewers can also register by phone by calling 915-351-9967 and leaving the secret code, name, address, daytime phone number and birth date between the hours of 10:30PM – 4PM.   Viewers can also register at the KTSM studios, 8:30AM - 4:00PM, at 801 N. Oregon, El Paso, Texas 79902.  

The rules are as follows:

1. Description of contest/Participation.
1A.  Dates of Contest:  The contest will begin and end on or about the start and finish dates as listed above:  April 23, 2008 – May 21, 2008

1B.  How to Enter:  Register online at ktsm.com by clicking on the PumpBuster Drive Away icon on the homepage.  Registration form must have the correct secret code or will be disqualified.  Viewers can also register by phone by calling 915-351-9967 and leaving the secret code, name, address, daytime phone number and birth date between the hours of 10:30PM – 4PM.   Or viewers can register at the KTSM studios, 8:30AM - 4:00PM, at 801 N. Oregon, El Paso, Texas 79902.  

Daily code will be revealed at 10PM.  Viewers have until 2PM the following day to register.   

KTSM or Borman Auto Plex are not responsible for any failed, lost or unavailable network connections, any garbled or delayed network transmissions, or any other electrical, mechanical or network malfunctions. 

All entries received that are mutilated, tampered with, or illegible will be void.

MECHANICALLY REPRODUCED ENTRIES NOT ACCEPTED.

Limit one entry per e-mail address per day or one drop-off (site registration) entry per
person per day or one telephone entry per day. However, during the course of the
“Contest” you may only be a “daily” winner once.

All entries become the property of KTSM Television and will not be acknowledged or
returned.

Winner must be in KTSM viewing area (as designated by Nielsen Media Research).
2. Prize(s).
The prize(s) that may be awarded to the eligible winner(s) are described above or as follows: 
20 Prize Winners Will Receive:  (1) $200 gas card and 1 GRAND PRIZE Winner Will Receive:  A 2008 Honda Fit in Tidewater Metallic by Borman Auto Plex

One daily winner will be selected in a random drawing from among all entries receive
as of the cut-off day and time listed in the rules.

Odds of winning depend on the number of eligible entries submitted.

Drawings will be held M-F beginning April 24, 2008 from the previous days entries. 
Example:  A clue will be revealed on April 23, 2008 at 10PM.  The winner from that clue
will be announced on April 24, 2008 at 10PM.  Each of the daily winners will receive
a $200 gas card.  Last clue will be revealed on May 20, 2008 and final winner will be
revealed on May 21, 2008.

Daily winners qualify for the Grand Prize Drawing on Saturday, May 24, 2008.

Winners eligible for Grand Prize Drawing must be present to win.  (Time and location
TBD)
 
All prizes are non-transferable.


3. Eligibility and Limitations.
Participants and winner(s) mst reside within the Station’s Designated Market Area
(DMA) as defined by Nielsen Media Research for the Station and must be a U.S. citizens
at least 18 years old as determined by Company.  No minors are allowed to participate.
Individuals who, prior to the awarding of prizes in this Contest, have won another prize
from KTSM during the preceding 365-day period in which prizes for this Contest are
awarded are not eligible to win this Contest.    Employees of Company and all
Sponsoring companies, their advertising and promotion agencies, employees of other
radio or television stations and members of the immediate family of any such persons are
not eligible to participate and win.  The term “immediate family” includes spouses,
siblings, parents, children, grandparents and grandchildren, whether as “in-laws,” or by
current or past marriage(s), remarriage(s), adoption, cohabitation or other family
extension, and any other person residing at the same household whether or not related.
VOID WHERE PROHIBITED BY LAW.

4. Telephone and Delivery Disclaimer.
Company disclaims all liability for the inability of a participant to complete or continue a telephone call or on-line entry due to equipment malfunctions, busy lines, inadvertent disconnections, website maintenance issues, acts beyond Company’s control or otherwise.  Company disclaims all liability for any delays, miss-delivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method.  Company also disclaims all liability in the event that the contest cannot be aired each day by reason of the occurrence of any Force Majeure.  Force Majeure may be an act of God, war, fire, flood, strike, labor dispute or lockout, public disaster, breaking news, interruption of electrical or telephone service or nay other cause not within reasonable control of the Company.

5. Publicity.
By participating, all participants and winner(s) grant Company exclusive permission to use their names, characters, photographs, voices and likeness in connection with promotion of this and other contests and waive any claims to royalty, right or remuneration for such use.

6. Release.
By participating, each participant and winner waives any and all claims of liability against Company, its employees and agents, for any personal injury or loss, which may occur from the conduct of, or participation in, the contest, or from the use of any prize.

7. Taxes.
Any valuation of the prize(s) stated above is based on available information to Company, and the value of any prize awarded to winner may be reported for tax purposes as required by law.  Each winner is solely responsible for reporting and paying all applicable taxes.  Each winner must provide Company with valid information and a valid taxpayer identification number or social security number before nay prize will be awarded.  All eligible winners will receive an IRS 1099 at the end of the calendar year and a copy of such form will be filed with the IRS. 

8. Decisions.
Company reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible or has violated any rule, gained unfair advantage in participating in the contest, or obtained winner status using fraudulent means.  Further, Company, will resolve any disputes or ambiguities concerning the rules and Company’s decisions concerning such disputes shall be final.

9. Miscellaneous.
Each winner must submit proof of eligibility and sign a Company release form to claim
The prize.  All winners must report to the KTSM studios within one business day of
winning with a driver’s license and sufficient proof of tax identification or social security
number.  No purchase necessary to participate or win.  Void where prohibited.  Odds of
winning depend on the number of participants.  Company may substitute prizes of
equivalent value, amend the rules or discontinue the contest at any time as announced on
the station.  Company disclaims any responsibility to notify participants of any aspect
related to the conduct of this contest.  Written copies if these rules are available during
regular business hours ate the KTSM studios or online.  Winner(s)’ list will be available
May 30, 2008 by sending a self-addressed stamped envelope to: WINNERS LIST, Pump
Buster Drive Away c/o KTSM, 801 N. Oregon, El Paso, Texas 79902


10. Compliance with Law.
The conduct of this contest is governed by local and state law, which takes precedence over any rule to the contrary herein.  Company shall follow the applicable local and state laws for conducting contests as may be required by local or state law.
